Özet
İfade özgürlüğü, liberal demokratik hukuk devletlerinde tanınmış en önemli bireysel hak ve özgürlüklerden biridir. İfade özgürlüğü sayesinde kişiler düşüncelerini açıklama imkânına sahip olurlar. Bu düşünceleri toplumun çoğunluğunun veya azınlığının benimsemesi önem arz etmez. Bununla birlikte, ifade özgürlüğünün azınlığın düşüncelerini ifade ederken sağladığı hukuki koruma sebebiyle özellikle önemli olduğu söylenebilir. Böylelikle toplumun azınlığını temsil eden fikirlere sahip bireyler, yeni bir toplumsal tartışma ortaya çıkarmak yahut hâlihazırda mevcut olan toplumsal bir tartışmada görüş beyan etmek için ifade özgürlüğünden faydalanırlar ve kendi görüşlerinin de hesaba katılmasını sağlarlar. İfade özgürlüğünün önemine binaen anayasal bir koruma sağlanmaktadır. Nitekim Alman Anayasası'nın "Temel Haklar" başlığı altında 5. maddesinde ifade özgürlüğü garanti altına alınmıştır. Ancak ifade özgürlüğü hiçbir sınırlamaya tabi olmaksızın istifade edilebilen bir hak değildir. Alman Anayasası'nın 5. maddesinin 2. fıkrasında ifade özgürlüğünün hangi hâllerde sınırlamaya tabi tutulduğu ifade edilmektedir. Bunlardan biri de bireylerin onurudur. Bireylerin onurunun söz konusu olduğu hâllerde ifade özgürlüğü kanunda belirtilen sınırlamalara tabidir. Bu bağlamda kişilerin ifade özgürlüğü ile bireylerin onuru çatışan iki menfaattir. Bunların arasında bir dengenin kurulması gerekir. Bu dengenin nasıl kurulacağı ile ilgili olarak Alman Anayasa Mahkemesinin vermiş olduğu ve verildiği dönemde oldukça tepki çeken "Asker Kararı", bu çalışmanın konusunu oluşturmaktadır.
Abstract
Freedom of expression is one of the most important fundamental rights recognized in liberal democratic constitutional states. Freedom of expression gives people the opportunity to express their thoughts. It does not matter whether the majority or minority of society accepts these opinions. In fact, freedom of expression plays an important role in protecting the minority in the event that they express their opinion. Therefore, opinions belonging to the minority enjoy the freedom of expression to initiate a new social debate or to express an opinion in an existing social debate and ensure that their personal views can be taken into account. Due to the importance of freedom of expression, constitutional protection is required. In fact, freedom of expression is guaranteed as a fundamental right in Article 5 of the German Constitution. But freedom of expression cannot be enjoyed without restrictions. Article 5 (2) of the German Constitution describes the cases in which freedom of expression is restricted. One of these cases is personal honor. When it comes to the honor of the individual, freedom of expression is restricted according to the legal regulation. In this context, freedom of expression and personal honor are two conflicting interests. These interests should be balanced. This essay deals with the decision of the so-called "soldiers' judgment" of the BVerfG with regard to the setting of this balance, against which critical voices from politicians and society were aroused.
