Bu makalede zorunlu unsur doktrinin çıkış noktası ve temel esasları, önemlimahkeme içtihatları ile birlikte incelenmiştir. Bu bağlamda Avrupa Adalet Divanı’nın zorunlu unsur doktrininin esas dayanağını oluşturan Oscar Bronner kararı hem hukuki, hem de ekonomik açıdan irdelenmiştir.
Abstract
In this essay, the origin and main characteristics of the essential facilities doctrine are analyzed through the case law. In this context, the Oscar Bronner ruling of the European Court of Justice that is the cornerstone of the doctrine, is discussed from both legal and economic perspectives.
