Özet
Makalenin amacı, nanoteknoloji alanında ulusal ve uluslararası hukuki ve kurumsal yapının gelişim seyrini ve mevcut durumunu ortaya koyarak, Türkiye'nin bu alanda izleyebileceği düzenleme ve yönetişim yaklaşımları hakkında bir çerçeve çizmeye çalışmaktır. Makalede geliştirilen kavramsal çerçevenin merkezinde, 'teknoloji-toplum ilişkisi' ve 'belirsizlik' (uncertainty) kavramı bulunmaktadır. Çalışmada, öncelikle belirsizlik ve risk yönetimine dair genel olarak bilim/teknik, özel olarak da nanobilim/nanoteknoloji alanındaki düzenleme ve yönetişim uygulamalarına dair mevcut literatür ele alınmaktadır. İkinci bölümde ise, önceki bölümde yer verilen yaklaşımların ışığında, nanoteknolojiye içerik belirsizlik, risk ve demokratik teknoloji kavramları çerçevesinde, Türkiye'de etkin, esnek ve katılımcı bilim ve teknoloji politikaları oluşturulması tartışılmaktadır. Çalışmada sonuç olarak, kısa vadede nano-spesifik düzenlemelerin mümkün görülmediği vurgulanmakta; ancak uzun dönemde öngörülebilecek olan nano-spesifik düzenlemelerin ise, soft ve hard normatif yapıların entegre edildiği adaptive hukuk yaklaşımıyla ve devlet ve devlet dışı aktörlerin dahil edildiği yapılara dayanan bir yönetişim anlayışıyla hayata geçirilmesinin önemine işaret edilmektedir.
Abstract
The purpose of this article is to reveal the current legal and institutional structure as on nanotechnology at both the national and the international level, with a view to contribute to the discussions surrounding Turkey's possible paths in developing a framework for regulation and governing in this field. In the center of the conceptual framework developed in the article lie, the concept of 'uncertainty' and 'technology-society relationship'. The study firstly goes over the existing literature on the subject of regulation and governance practices related to uncertainty and risk management in science and technology in general and in nanoscience and nanotechnology in particular. In the light of the approaches and practices given in the previous section, the following part discusses the creation of effective, flexible and participatory science and technology policies in Turkey encompassing uncertainties, risks and democratic technology concepts peculiar to nanotechnology. As a concluding remark, the study emphasizes that the creation and application of nano-specific regulation seems unlikely in the short term. On the other hand, if nano-specific regulation is to be envisaged in the long term, the study points out the importance of adopting the adaptive law approach that integrates the hard and soft normative structures with a governance model based on a model in which both the State and the actors outside the State would be included to ensure the incorporation of the societal concerns in the development of technology and applied sciences.
