Özet

Özellikle, son yıllarda inşaat sektörünün gelişmesi sonucunda, yapımı henüzbitmemiş bağımsız bölümlerin satılması ihtiyacı belirmekte ve bu ihtiyaç da satış vaadi yoluna başvurularak giderilmeye çalışılmaktadır. Bu çalışmada, satış vaadi borcunun ifa edilmemesi halinde, satış vaadi alacaklılarının söz konusu gayrimenkulü elde etmeleri için sahip oldukları imkânlar incelenmiştir.

Abstract

In recent years, as a result of developments in the construction sector, it wasnecessary to design a legal instrument to allow for the possibility to sell detached sections of unfinished construction projects. It was thought that this instrument could be based on a sales commitment contract. This essay examines the remedies available to the buyer in case of the seller’s not honouring the sale commitment.
