Özet

Bu çalışmada, Türk Medeni Kanunu md. 321 c. 1’deki ana ve baba evli ise çocuk ailenin soyadını taşır, kuralı incelenmektedir. Bu çerçevede, öncelikle ana ve babası evli olan çocukların kimler olduğu, aile soyadı kavramının neyi ifade ettiği açıklanmıştır. Daha sonra ise, TMK md. 321 c. 1’deki kuralın, MK md. 27 f. 1 çerçevesinde istisnasının olup olmadığı, öğretideki görüşler ve Yargıtay kararları dikkate alınarak incelenmiştir.

Abstract

In this article the author discusses the Turkish Civil Code (“TCC”) Art. 321 s.1, which provides that the child bear the surname of the family rule. The author examines the meaning of the statement “ the child whose parents are married” and the concept of family surname. The author also examines whether 27/1 TCC is the exception of Art. 321 s. 1 TCC in the framework of different opinions and Turkish High Court decisions.
