Özet
Şantaj suçu 5237 sayılı Türk Ceza Kanununda kişilere karşı suçlar arasında düzenlenmiştir. Düzenlenme itibariyle tehdit suçunun çıkar sağlamak amaçlı nitelikli hali görünümündedir. Ancak bağımsız bir suç olarak düzenlenmiştir. Bu çalışmada şantaj suçunun benzer diğer suçlardan farkı ele alındıktan sonra suçun unsurları ayrıntılı şekilde açıklanacaktır.
Abstract
The crime of extortion is prescribed in Turkish Penal Code no. 5237 under the chapter on crimes against persons. The provision portrays the crime as the qualifed version of coercion, where the offender aims to gain a benefit. However, it is defined as an independent crime. In this work, firstly the differences between extortion and other crimes will be examined and subsequ- ently the elements of extortion will be discussed in detail.
