Özet

Sapma halinde uygulanacak hükümlerin tespiti 5237 sayılı Türk Ceza Kanunu’nun yürürlüğe girmesinden sonra tartışmalı bir konu halini almıştır. 765 sayılı Türk Ceza Kanunu’nda tek neticeli sapma hali, hata hali ile aynı hükümde düzenlenmiş olmasına rağmen, yeni kanunda sapmaya ilişkin herhangi bir hükme yer verilmemiştir. Ancak hatayı düzenleyen 30. madde ile fikri içtimaı düzenleyen 44. maddenin gerekçelerinde sapma halin de uygulanacak hükümlere ilişkin bir takım açıklamalar yapılmaktadır. Bu çalışmada sapma kavramını ortaya koyduktan sonra, 765 sayılı Türk Ceza Kanunu’nda ve ceza kanunu tasarılarında sapma halinin ne şekilde yer almakta olduğunu inceleyeceğiz. Ardından 5237 sayılı Türk Ceza Kanunu’ndaki düzenlemeleri açıklayacak ve bilhassa “fiil” ve “hareket” kav ramları doğrultusunda ileri sürülen görüşlere yer vererek kişisel kanaatimizi belirteceğiz.

Abstract

Upon the enactment of Turkish Penal Code nr. 5237, there has been a considerable debate over the notion of aberratio ictus. While Turkish Penal Code nr. 765 regulated the cases of aberratio ictus with singular outcome and error under the same provision, there is no provision on aberratio ictus in the new code. However, the motives of Articles 30 and 44 include directions on how to apply certain provisions of the new code in case of aberratio ictus. In this study, the concept of aberratio ictus shall be explained, and regulations of the Code nr. 765 regarding the issue shall be examined. Subsequently, the regulation of Turkish Penal Code nr. 5237 shall be analysed with a focus on opinions related to concepts of “deed” and “action”, followed by a personal assesment on the matter.
