Risk yönetimi, özen ilkesi ve suç politikası

Özet

Birey yalnızca onu etkileyen ya da öncelikle onu etkileyen riskle- rin sorumluluğunu, Devlet ise kendi ya da toplum ya da en azından toplu- mun önemli bir kesimini etkileyen risklerin sorumluluğunu üstlenir. Devlet geliştikçe ve toplum karmaşıklaştıkça bu risk yönetimi paylaşımı Devlet lehine değişmiştir. Riskler içerik açısından çok çeşitli ve farklıdır. Bu çalış- mada yalnızca insani kökenli riskler ele alınmış, onların arasından da bir suçun işlenmesinin neticeleri irdelenmiştir.

Abstract

An individual takes the responsibility of risks that affect exclusively or primarily himself or herself, whereas a state takes the responsibility of risks that affect itself, the society, or a significant part of the society. As states get more developed and the society gets more complicated, the share of risk management changes in favor of the state. Risks are of various types. Anthropogenic risks constitute the subject matter of this study, and the consequences of the commission of an offence are examined.
