Özet

Üç aşama testi, telif hakkı sahiplerinin menfaatlerinin korunması ve bununla birlikte kamu menfaatinin de göz ardı edilmeyerek, fikri mülkiye- te konu olan eserin ücretsiz kullanılabilmesi amacına yönelik olan bir tes- pit mekanizmasıdır. Bir başka deyişle üç aşamalı bir inceleme ile telif hak- kı sahiplerinin menfaatlerine bir istisna olarak, telif hakkı ve kullanıcıların serbest kullanımının çekişmeli olduğu hallerde çözüme yönelik mümkün olduğunca nesnel bir çözüm ortaya koymaya çalışır. Üç aşamadan oluşan bu incelemede; mutlak ve özel bir halin varlığı, eserin olağan kullanımı ile çatışmayacak bir durumun söz konusu olması ve son olarak yazarın meşru menfaatlerine makul olmayan bir biçimde halel getirmemesi aranır.

Abstract

The Three Step Test is a determination mechanism which aims to protect a copyright owner’s interests in the scope of intellectual property law for free or restricted use of a work. The Test tries to create an objec- tive standard in the event of conflicts between copyright owners and users. The three step analysis as an exception to the interests of copyright own- ers. The test asks whether there is 1) a presence of a certain special case 2) which does not conflict with the normal exploitation of the work and 3) which does not unreasonably prejudice the legitimate interests of the au- thor.
