Özet

Federal bir çatı altında, ayrı ayrı eyaletlerden/devletlerden oluşan bir yönetim yapısının gerektirdiği denge, Amerika Birleşik Devletleri’nde yargısal fonksiyonun mükemmel işletilmesi gereğini ortaya çıkarmıştır. Tarafsız bir yargıya olan ihtiyaç, yargı organının temel öğelerinden olan hâkimlerin tarafsızlığının sağlanmasına ilişkin düzenlemelerin yürürlüğe konulmasına neden olmuştur. Amerikan hukuk sisteminde hâkimlerin red- dine ve çekilmelerine ilişkin iki temel düzenleme bulunmaktadır. Bu dü- zenlemeler, federal kodifikasyonun 28. başlığının 144. ve 455. kısımları içerisinde yer almıştır. Bu iki temel düzenlemeye ek olarak aynı başlığın 47. ve 2106. kısımlarında temyiz mahkemesi hâkimlerinin reddi ve çekil- mesine yönelik düzenlemelere de yer verilmiştir. Hâkimin reddi ve çekil- mesi ile ilgili uygulamada birçok sorun bulunmaktadır. Bunların başında, hâkimin reddine ilişkin talebin, reddi istenilen hâkim tarafından ve çoğu zaman gerekçesiz olarak karara bağlanması gelmektedir. Bir diğer problem ise eyalet mahkemesi hâkimlerinin seçim kampanyalarından kaynaklan- maktadır. Seçim süreci boyunca toplanan bağışlar ve sergilenen politik duruş daha sonraki meslek yaşamında, hâkimlerin tarafsızlığının sorgulanmasına neden olabilmektedir. Bu sorunların çözümüne yönelik çalışma- lar yapılmakta ve çözüm önerileri ortaya konulmaktadır.

Abstract

The requirement of a balance under the federal structure/roof which consists of individual states needs a judicial function that operates perfect- ly in the U.S. The need of impartial judiciary has led to enactments of reg- ulations which ensure impartial judges, the basis of the judicial body. There are two main acts regarding recusal and disqualification of judges in the U.S legal system. These are 28 U.S.C. § 144 and 28 U.S.C. § 455. In addition to these two principal statutes, the disqualification of appellate judges is set forth under 28 U.S.C. § 47 and 28 U.S.C. § 2106. In practice, there are several problems regarding recusal and disqualification of judg- es. The major problem is that the motion for disqualification of a judge is handled by the judge in question and the concerned judge mostly does not put forth his rationales while deciding. Another problem is due to the elec- tion campaigns of state court judges. The donations collected and the po- litical stance presented during the selection process may lead to question- ing the impartiality of the judges in their subsequent professional life. Some research are being done and solution suggestions are being present- ed.
