Özet

Bu makalede hekim ile hasta arası ilişkinin özellikleri ve nitelikleri incelenmiş tir. Özellikle 818 Sayılı Borçlar Kanunundaki vekâlet sözleşmesi hükümleri çerçevesinde, hekimin borçları ve sorumlulukları değerlendirilmiştir. Bazı hususlar, 6098 sayılı Türk Borçlar Kanunu ile karşılaştırmalı olarak incelenmiştir.

Abstract

The following paper examines the characteristics and attributes of therelationship between physician (medical doctor, practitioner, etc.) and patient. The obligations and responsibilities of the physician, especially within the framework of the provisions of the contract of mandate under the Code of Obligations no. 818 are discussed. A brief comparison is made between these provisions and the provisions in the new Turkish Code of Obligations no. 6098.
