Özet
TCK. 122. maddesinde yeni bir suç düzenlenerek çeşitli nedenlerin etkili olduğu nefretle bireyler arasında ayırımcılık yapılması önlenmek istenmiştir. Bu suçun cezalandırılması ile Anayasa'da yer alan eşitlik ilkesinin korunması amaçlanmıştır. Suçun unsurlarının ele alındığı bu incelemede, konunun getirdiği sorunlar çözümlenmeye çalışılmıştır.
Abstract
A new type of crime is worded in Art.122 of Turkish Criminal Code. The discrimination issue among the society members that is formed out of hatred due to various reasons, is aimed to be prevented with this new Article. Therefore, the principle of equalization set in the Constitution is also aimed to be protected. The elements of the crime that are set out in this study, are explained along with the answers to specific matters.
