Özet

Gelişen teknoloji ile birlikte bilgisayar kullanımının hızla artması ve hayatımızın her alanına dâhil olması, toplumsal düzeni korumaya yönelik adımlar atmakla görevli devletlerin, bu yeni teknoloji karşısında birtakım düzenlemeler yapmasını zorunlu kılmıştır. Bunun sonucunda birçok devlet, mevzuatında bilgisayar kullanılarak işlenebilen suçlara yer verdiği gibi ceza yargılaması da hem bilgisayar ile işlenen suçlara ilişkin delil elde edebilmek hem de diğer suçlarla etkin mücadele edebilmek adına bu sürece kayıtsız kalamamış ve gerek bilgisayar gerekse diğer elektronik aletlerde yer alan delillerden yararlanmaya başlamıştır. Türk hukukunda da bu ihtiyacı karşılamak üzere ihdas edilen bilgisayarlarda, bilgisayar programlarında ve kütüklerinde arama, kopyalama ve elkoyma tedbiri de (CMK m. 134), 6526 sayılı kanunla önemli ölçüde değişikliğe uğramış ve ilgili tedbire başvuru şartları ağırlaştırılmıştır. Bu çalışmanın amacı, son değişiklikler çerçevesinde CMK md. 134'ün genel bir incelemesini yapmak ve ilgili maddenin uygulamada nasıl yorumlandığını belirlemek olacaktır. Tüm bu hususların daha iyi anlaşılabilmesi adına kısa bir şekilde koruma tedbirlerinin özelliklerine de değinilecek akabinde CMK md. 134 incelenecektir.

Abstract

With the development of technology, the use of computers increased rapidly and involved in every aspect of our life, taking steps towards the protection of the social order, it is obligatory for the responsible states to carry out certain regulations in the face of this new technology. As a result, many states have committed crimes that can be committed using the computer in their legislation, and criminal proceedings have not been able to remain indifferent to this process in order to obtain evidence of computer crimes and to effectively combat other crimes and have begun to take advantage of the evidence contained in other electronic devices. In Turkish law, searching, copying and seizure measures in computers, computer programs and registers, which are arranged to meet this need, have been significantly changed by the law numbered 6526 and the requirements for the application of the related laws have been aggravated. The intent of this study is to make a general examination of the Code of Criminal Procedure No. 5271 article 134 and to determine how it is interpreted in practice by taking into consideration recent changes.
