Özet
Feminist düşüncenin bir hukuk teorisine sahip olup olmadığı tartışmalıdır. Bir görüşe göre, feminizmin hukuka ilişkin bazı eleştiri ve tespitleri vardır ama bunlardan bir hukuk teorisi ortaya çıkmaz. Çünkü bu tespitler bir hukuk teorisinin ele alması gerektiği bütün alanlara değil, yalnızca bunların küçük bir bölümüne ilişkindir. Diğer görüş ise, bir hukuk teorisinin mutlaka hukukun kaynağı, işlevi, amacı ve niteliği konusunda kapsamlı açıklamalar getirmek zorunda olmadığını belirtir. Hukukun bütün bu alanlarında kapsamlı ve ayrıntılı açıklamalar getirmese de, kendisini diğer teorilerden farklılaştıran noktaları açıklıkla ortaya koyan sistematik ve bütünlüklü görüşler de bir hukuk teorisi olarak kabul edilebilir. Feminizm, erken tarihlerden itibaren, hukukun kadın üzerindeki erkek tahakkümünü pekiştiren işlevini başarılı bir şekilde ortaya koymuş ve bu durumun değişmesi için mücadele etmiştir. Bu eleştirel yaklaşımın yanı sıra, feminist düşüncenin bir kolu, kadınların adil bir toplumsal düzenin temeli olabilecek farklı bir ahlaki bakış açısına sahip olduklarını ileri sürer. Özen ahlakı olarak adlandırılan bu farklı yaklaşım, erkeklerin adalet ahlakından daha üstün görülür. İşte, bu güçlü iddiayla birleştirildiğinde, feminizmin, hukuka ilişkin eleştiri ve değerlendirmeleriyle, ortaya incelenmeye değer bir hukuk teorisi çıkardığını kabul etmek gerekir.
Abstract
Is there a feminist theory of law? This is a very controversial issue. In one view, there are some feminist critics of the law, but it cannot be said that these criticisms have turned into a comprehensive legal theory since these criticism relate only to a small part of them, not to all areas where a legal theory should be addressed. The other point of view is that a legal theory does not necessarily have to provide comprehensive explanations on the whole of the source, function, purpose and nature of law. Although the feminist point of view does not provide comprehensive and detailed explanations in all of these areas, the systematic and coherent opinions that openly express the points that differentiate it from the other theories can be considered as a unique theory of law. From an early date, feminism has found that the law reinforces male domination over women. In addition to this critical approach, a branch of feminist thinking suggests that women have a different moral perspective in which a fair society can be established. This different approach, called ethics of care, is seen as superior to men's ethics of justice. Now, when combined with this strong argument, it is necessary to acknowledge that feminist criticism and evaluation of the law has turned into a theory of law worthy of examination.
