Özet
Anayasa'nın 20, 24, 25 ve 26. maddeleri ile Avrupa İnsan Hakları Sözleşmesi'nin 9 ve 10. maddelerinde düzenlenmiş bulunan inanç, düşünce ve kanaat hürriyetlerini ihlal eden çeşitli fiiller Türk Ceza Kanunu'nun 115. maddesinde suç olarak tanımlanmıştır. Makalede bu suç tipinin tarihçesine ve karşılaştırmalı hukuktaki benzerlerine yer verildikten sonra, maddede düzenlenen fiiller sistematik olarak incelenmiştir. Özellikle güncel örneklerden yola çıkılarak hangi davranışların suç olarak değerlendirilmesi gerektiği yönünde tartışmalara yer verilmiş ve Yargıtay içtihatları ile suçun uygulama alanı eleştirel bir gözle tespit edilmiştir.
Abstract
Several acts violating the freedom of thought, conscience and expression, as regulated under the articles 9 and 10 of the European Convention of Human Rights, and articles 20, 24, 25 and 26 of the Turkish Constitution, have been defined as criminal offenses under article 115 of the Turkish Criminal Code. After dealing with the historical background of the offense, similar offenses in comparative law, this article focuses on the systematical analysis of the definition under the TCC. Discussions about which actions and omissions to consider as criminal are reflected with emphasis of current examples, and the scope of the provision is determined by using the case-law of the Turkish Court of Cassation, with a critical point of view.
