Özet

İnsanın sırf insan olması nedeniyle onura sahip olduğu kabul edilse deinsan onuru kavramı üzerinde her zaman geçerli olan ve herkesinuzlaşacağı kesin bir tanımın yapılması olanaklı değildir. Kesin bir tanımınyapılması, insan onuru kavramının belli bir anlayış ya da dünya görüşünebağlı kalması tehlikesinin yanı sıra, yeni ihlal olasılıkları karşısındakorumasızlığını da beraberinde getirebilecektir. Nitekim Alman FederalAnayasa Mahkemesi, insan onurunun mutlak bir kavram olmadığını vedaima somut olay ile birlikte değerlendirilmesi gerektiğini ifade etmiştir. Buçalışmanın amacı da, biyotıp uygulamaları karşısında insan onurunaverdiğimiz anlamı güncellemektir. Zira bugün biyotıp uygulamalarkapsamında yer alan düzenlemelerin temelinde bireysel onurunkorunmasından çok “kolektif,” yani “insanlık onuru”nun korunmasıbulunmakta; insanlık, insan kimliği, insan hayatı, gelecek nesiller gibi dahasoyut kavramlar merkeze alınmaktadır. Klasik bireysel insan onuru anlayışından türeyen bu yaklaşım, insan geliştirme yöntemleri, klonlama vegenetik müdahaleler gibi bazı teknolojilerin, insan türünün varlığına karşıtehdit oluşturduğu tartışmalarından kaynaklanmıştır.

Abstract

Altough it is assumed that human dignity is derived only from humannes, it is not possible to make a pricise definition that always applies to the concept of human dignity. Therefore making a definite definition will bring about the danger of the human dignity concept being adhered to a certain understanding or a world view, as well as the unprotectedness of new violation possibilities. Thus, The German Federal Constitutional Court stated that human dignityis not an absolute concept and should always be considered together with the concrete event. At this point, it emerges that the concept and its related violations must be assessed in a concrete way depending on the changes that occur over time. Accordingly, the aim of this study is to update the meaning we give to human dignity in the context of biomedical applications.Today, on the basis of regulations within the scope of biomedicine applications, rather than the protection of individual dignity, the protection of "collective," or "humankind dignity," is on the forefront. In this context, more abstract concepts such as humanity, human identity, human life, future generations are taking place. This approach, deriving from classical individual human dignity, reveals that some technologies, such as human enhancement methods, cloning and genetic interventions, pose a threat to the existence of the human species and that human dignity can be violated in this respect.
