Özet
Çalışmamızın konusunu adil yargılanma hakkı ve bu hakkın ihlalihalinde gidilebilecek yasal yolların neler olduğu oluşturmaktadır.Çalışmamızın ilk kısmında hakkın esasını oluşturan unsurlar üzerinden adilyargılanma hakkının içeriği incelenirken yeri geldiğince Avrupa İnsanHakları Mahkemesi içtihatlarından faydalanılmış, Mahkeme’nin hakkıyorumlayış tarzı ortaya konulmaya çalışılmıştır. Hakkın ihlali halindegidilebilecek yasal yolların yer aldığı ikinci bölüm, ilk bölüme kıyasladetaylı incelenmeyecek olup genel hatlarıyla belirtilecektir.Demokratik hukuk devletinin özelliği ve bir gereği olarak bağımsız vetarafsız olması gereken yargı makamlarında adil bir yargılanmadanbahsedilebilmesi için mahkemeye erişim hakkının olması, yasa ile kurulanbağımsız ve tarafsız mahkemenin olması, yargılamanın makul süreiçerisinde yapılması, yargılamanın kamuya açık olması ve hakkaniyete uygun yargılama yapılması gerekmektedir. Adil yargılanma hakkının ihlaledilmesi halinde taraflar Anayasa Mahkemesi ile Avrupa İnsan HaklarıMahkemesi’ne bireysel başvuru hakkına sahiptir.
Abstract
The subject of our article consists of the right to fair trial and what are the legal procedures one can take under the violation of the right in question. In the first part of our study, the context of the right to fair trial is examined through the elements which form the core principals of the right while taking into account the court practices of the European Court of Human Rights and as well the interpretation method of the court on the right in practice. In the second part where the legal procedures are explained under the violation of the right won’t be examined fully in detail compared to the first part of our study and will be described in general terms. In order to mention of a fair trial at the judicial offices which should be independent and impartial by nature as a necessity and a characteristic of democratic constitutional state, there needs to be the right of access to a court, the presence of independent and impartial courts established by the law, the implementation of the jurisdiction within reasonable time, open to general public and the practice of equitable jurisdiction. In the case of the violation of the right to fair trial, the parties have the right to make an individual application to Constitutional Court or the European Court of Human Rights.
