Özet
Bu makalenin amacı onarıcı adalet kavramının ortaya çıktığını akademikZeitgeisti inceleyerek, adalet tartışmaları çerçevesinde onarıcılık kavramınıntarihsel başlangıçlarını analiz etmektir. Bu amaçla, onarıcı süreçlerin temelözellikleri tartışıldıktan sonra, onarıcı bakış açısının popülarite kazandığı1970’lerde adalet ve cezalandırma politikaları alanında öne çıkan ve onarıcıhareketine ilham veren tartışmalar incelenmiştir. Onarıcı adaletin, suç veadalet politikaları alanında yeni bir bakış açısı olarak şekillenmesine temeloluşturan ve temel eser olarak kabul edilen üç makalenin (Eglash, 1958;Barnett, 1977; ve Christie 1977) katkıları detaylı olarak analiz edilmiştir.Bununla kalmayarak, onarıcı adalet literatürünün başlangıcı sayılan NilsChristie’nin (1977) makalesinin Türkçe çevirisi da bu makalenin ekindeokuyuculara sunulmuştur. Böylece, bu makalenin literatürdeki yerinitartışarak, nasıl okunması ve anlaşılması gerektiğine dair bir çerçeveoluşturulmuştur.
Abstract
The aim of this paper is to analyze the historical beginning of the restorative concept in the context of justice, by exploring the academic zeitgeist in which it emerged. To achieve this, first the main characteristics of the restorative process are discussed, followed by the discussion of justice and penal policy debates that were prominent in the 1970s – the time period when restorative justice ideas gained their ground. Contributions of three articles (Eglash, 1958; Barnett, 1977; and Christie 1977) which were published as restorative justice concept had started to emerge as a new approach to crime and justice debate in this time period, and are considered to be formative for the restorative justice debate, have been analyzed. Further, the translation of one of those articles (Christie 1977) has been provided as an Annex to the paper. In this way, by first discussing the place of this article in the restorative justice literature, a framework for its reading and understanding has been constructed.
