Özet
Temel hakların kabul edilmesi sürecinde geçmişi eskiye dayanan sübjektif kamu hakkı olarak ortaya çıkan dilekçe hakkı, kişinin belirli bir konu ile ilgili dilek ya da şikâyetini kamusal mercilere yöneltmesi şeklinde tanımlanır. Bu çalışma, dilekçe hakkının Federal Alman anayasa hukuku özelinde incelenmesi konusuna özgülenmiştir. Bu bağlamda öncelikle dilekçe hakkının Federal Alman anayasa hukuku örneğinde tarihsel gelişimi ortaya konacaktır. Bu incelemeden sonra ise “dilekçe” kavramından ne anlaşılması gerektiği belirlenecektir. Zira bir hukuki metnin “dilekçe” olarak nitelendirilmemesi durumunda dilekçe hakkının uygulama alanı bulamayacağı açıktır. Dilekçe hakkının hukuki niteliği, hakkın özneleri ve yükümlüleri, hakkın konusu ve söz konusu hakkın ihlal edilmesi hâlinde başvurulabilen yargısal denetim yolları da aynı şekilde bu çalışma çerçevesinde üzerinde durulması gereken hususlardandır. Ayrıca, günümüzde özellikle Federal Meclis’e sunulmuş dilekçelerde dilekçe komisyonunun görevinin arz ettiği önem ve bu komisyonun hukuki dayanağının Federal Anayasa’da düzenlendiği göz önünde bulundurulursa, dilekçe hakkı ile komisyon arasındaki ilişkinin de tespit edilmesinde yarar vardır.
Abstract
The right to petition, which emerged as an old subjective public right in the process of the adoption of fundamental rights, is defined as directing a person's wishes or complaints about a particular issue to public authorities. This study is devoted to the examination of the right to petition in the context of German Federal Constitutional Law. In this context, we will put forth the historical development of the right to petition in the example of German Federal Constitutional Law. After this verification, we will specify the things that should be understood from the concept of "petition". Because if a legal text is not considered as a petition, it is clear that the right of the petition will not be applicable. The legal characteristic of the right to petition, subjects and obligators of the right, the object of the right and judicial review methods that can be used in case of violation of this right are also issues to be considered within the framework of this study. Also, if we especially take into consideration that the legal basis of the petition commission is regulated in the Federal Constitution and the importance of the duty of this commission about the petitions submitted to the Bundestag nowadays, it is useful to determine the relationship between the right to petition and the commission.
