Özet
Anayasalar devletin temel kuruluşunu ve işleyişini düzenleyerek devlet organlarının yetki alanını belirler ve bireylerin devlete karşı sahip oldukları temel hak ve özgürlükleri güvence altına alırlar. Devlet yetkilerini normlar, değerler ve kurallar çerçevesinde belirleyen anayasalar bu yönüyle toplumsal sözleşme niteliğindedirler. Anayasayı oluşturan kurucu iktidarlar ise sadece devlet yapısını değil, aynı zamanda devletin siyasi kimliğini de biçimlendiren, anayasanın ve anayasanın üzerine inşa edildiği gücün ana kaynağıdır. Dolayısıyla anayasaların oluşum sürecinde geçirdiği aşamaların tümü, kurucu iktidar dahil, meşruiyet sorgusunu da beraberinde getirmektedir. Bu nedenle çalışmada anayasa ve kurucu iktidar ilişkisi değerlendirilmeye çalışılmış, anayasaların oluşum sürecinde çeşitli biçimlerde ortaya çıkan meşruiyet tartışmaları ele alınmıştır.
Abstract
Constitutions regulate the basic establishment and functioning of the state and also guarantee the fundamental rights and freedoms of individuals against the state. Constitutions that determine state powers through norms, values and rules in this respect,constitute social contract. The constituent powers which are the main source of the power on which the constitutions are built, forms not only the state structure but also the political identity of the state. Therefore, all of the stages of the constitution's formation process, including the constituent power, raises the question of legitimacy. This study aims to evaluate the relationship between the constitution and the constituent power and the legitimacy discussions that emerged at various stages in the formation process of the constitutions from a legal perspective.
