Özet

Parlamento adına yürüttükleri denetimler aracılığıyla kamu yönetiminde verimlilik, etkinlik, hesap verebilirlik ve saydamlığın güvence altına alınmasında kilit rol oynayan yüksek denetim kurumları (YDK’lar), birçok ülkede sahip oldukları yargısal işlevleri aracılığıyla uyguladıkları ilave yaptırımlarla hesap verme sorumluluğunun daha da güçlendirilmesine ve yönetimin hukuk içinde hareket etmesine katkı sağlamaktadır. INTOSAI tarafından geliştirilen YDK’ların Yargısal Faaliyetlerine İlişkin İlkeler (INTOSAI-P 50), bu kurumların yargısal işlevlerinin çerçevesini ortaya koymakta, aynı zamanda bu işlevlerin evrensel normlar doğrultusunda daha etkin ifası için önemli bir temel oluşturmaktadır. Bu çalışmanın amacı, söz konusu ilkelerin YDK hesap yargısının etkinliğinin ve evrensel normlara uygunluk düzeyinin artırılmasına etki potansiyelini analiz ederek, özellikle Türkiye Sayıştayı için mevcut uygulamaların bu ilkelerle kıyaslanması suretiyle geliştirilmesi gereken alanları ve hesap yargısının güçlendirilmesi için yapılması gerekenleri ortaya koymaktır.Sayıştayın yargısal faaliyetleri bu ilkelerle kıyaslandığında, yargı yetkisinin anayasal ve yasal düzenlemelerde açık ve güçlü dayanaklara sahip kılındığı; Sayıştay üyelerinin bağımsızlığı, bilgiye erişim, zamanaşımı, kanun yollarının varlığı, aynı aykırılık için tek yaptırım gibi ilkelerin de aynı şekilde yasal düzenlemelerde yeterince karşılık bulduğu görülmektedir. Adil ve tarafsız yargılama, yargısal faaliyetlerin etkinliği, kalite kontrolü, makul sürede yargılama ve halkla iletişim gibi sübjektif değerlendirmelere fırsat verecek ilkelerin ise belirli düzeyde karşılandığı açık olmakla birlikte, kurumsal dönüşüm çalışmaları kapsamında kaydedilen gelişmelerin sürekliliğinin sağlanması ve bu alanların kurumsal gelişim stratejisinin bir unsuru haline getirilmesi ile bu ilkelerin daha ileri düzeyde karşılanabileceği değerlendirilmiştir

Abstract

Supreme Audit Institutions (SAIs), which play a key role in ensuring efficiency,effectiveness, accountability and transparency in public administration through the auditsthey carry out on behalf of the Parliament, contribute to the further strengthening ofaccountability and the functioning of management within law with the additional sanctionsthey impose through their judicial functions in many countries. The Principles of JurisdictionalActivities of SAIs (INTOSAI-P 50) developed by INTOSAI reveals the framework of thejudicial functions of these institutions, and provides an important basis for a more effectiveperformance of these functions in line with universal norms. The purpose of this study is toanalyze the potential of these principles to increase the effectiveness of the judgement ofaccounts by SAIs and the level of compliance with universal norms and determine the areasthat needs improvement and what need to be done to strengthen judgment of accountsespecially by comparing the current practices of Turkish Court of Accounts (TCA) with theseprinciples. When the judicial activities of the TCA are compared with these principles, it is seenthat the jurisdiction power has clear and strong basis in constitutional and legal regulations;principles such as the independence of the SAI members, access to information, statute oflimitations, the existence of legal remedies, and accumulation of sanctions for the sameirregularity have strong basis in legal regulations as well. While it is clear that the principlesthat will enable subjective evaluations such as fair and impartial judgment, effectivenessof jurisdictional activities, quality control, judgement in a reasonable period andcommunication to the public are met at a certain level, it has been evaluated that ensuringthe continuity of the developments within the scope of the institutional transformation studiescan be achieved by making these areas an element of the corporate development strategy.
