İslâm hukukçuları meseleler hakkında hüküm verirken yalnızca dış dünyadaki objektif durumudikkate almamışlar, adalet ve hakkaniyet fikri temelinde ideal bir hukuk normu ortaya koymakhedefiyle objektif duruma aykırı bazı düzenlemelerde de bulunmuşlardır. Takdirî hüküm aslın- da mevcut olan bir şeyi veya durumu yokmuş gibi kabul etmek yahut aslında mevcut olmayanbir şeyi veya durumu varmış gibi kabul ederek hüküm vermektir.Bu makalemizde Hanefî fıkıh düşüncesinde takdirî hükmün gerekçelerini ve uygulama alanınıSerahsî‟nin el-Mebsût adlı eseri çerçevesinde ele alıp irdeleyeceğiz.

Abstract

In process of judging Islamic Jurists not only considered the objective cases in the outer worldbut also organizated some rules that are opposite to the objective cases aiming to set up idealjuridicial norms on the base of justice and equity. Recognitive judgement is in fact consideringthe existing case as if it doesn‟t exist or considering the unexisting case as if it exists.In this article we will examine the reasons and application areas of recognitive judgementwithin the Hanafi juridicial thought in accordance with Sarakhsi‟s al-Mabsut.
