Özet
İş güvencesi, işçilerin kendi davranışlarından veya işteki verimliliğinden kaynaklanmayan nedenler dışında, istihdam ve gelir kaybına karşı tam zamanlı işçileri korumayı amaçlayan bir uygulamadır. Türkiye, 158 sayılı Hizmet İlişkisine Son Verilmesi Sözleşmesini 1994 yılında kabul etmiştir. .Bunun sonucu olarak,Türkiye'de 1475 sayılı Kanun'un 13. Maddesinin değiştirilmesi gerekmekteydi. Bu düzenleme, 2003 yılının Mart ayında gerçekleştirilmiştir. Bugün, Türkiye'de iş güvencesi, 4773 sayılı Kanunla sağlanmış ve kanunun yürürlüğe giriş tarihi 30 Haziran 2003 tarihi olarak kabul edilmiştir.Bu makalenin amacı, 4773 sayılı Kanunla getirilen iş güvencesini sağlanmasına ilişkin yasal düzenlemenin yapısal özelliklerinin belirlenmesi ve iş güvencesinin, Türkiye'de işgücü piyasası üzerindeki olası etkilerini analiz etmektir. İş güvencesinin etkileri, Türkiye işgücü piyasasının ve ekonomik yapının özellikleri tarafından belirleneceği kabul edilmektedir.
Abstract
Job security is a practice that protects full-time workers against the loss of employment and earnings for reasons unrelated to their job performance or behavior. Turkey has accepted the Termination of Employment Convention No. 158 in 1994. As the result of this, it was necessity to change the article 13 of the Code 1475 in Turkey. This regulation has been realized in the march of 2003. Today, in Turkey, the job security will be protected by the Code 4773, and the date of the entry into force has been postpone to 30th of June, 2003. The purpose of this paper is to determine the structural characteristics of this legal regulation related the job security and to analyze the probable effects of the job security protected by the Code 4773 to the labor market in Turkey. It is accepted that the effects of the job security have been determined by the characteristics of Turkish labor market and the structure of the economy.
