Özet

İnsan hakları hukukunda vicdani red konusu, son yıllarda tartışılan ve Avrupa İnsan Hakları Mahkemesi’negöre inanç özgürlüğü bağlamında korunması gereken bir konudur. Dar anlamda vicdani red, savaş karşıtlığıve zorunlu askerlik uygulamalarına karşı girişilen bir “haktır”. Vicdani reddi destekleyenler, redciler içinzorunlu askerlik hizmetine alternatif olarak, sivil kamu hizmeti olması gerektiği düşüncesi doğrultusunda“vicdani red hakkı” mücadelesi vermektedirler. Vicdani reddi bir hak olarak doğrudan tanıyan, Türkiye’nintaraf olduğu bir insan hakları sözleşmesi yoktur. 1982 Anayasası’nın vatan hizmeti kenar başlıklı 72.Maddesinde esasen askerlik hizmetine alternatif, sivil kamu hizmetinin de uygulanabileceğine imkântanınmıştır. Ancak 1111 Sayılı Yasa, Türkiye’de askerliği zorunlu tutarak Anayasa’da tanınan bir ‘hakkı’engellemiş durumdadır.

Abstract

The subject of conscientious objection in human rights law has been debated in recent years and according to the European Courts of Human Rights, it should be protected within the context of freedom of belief. In the strict sense, conscientious objection is antagonism of war and it is a "right" that has been introduced against the compulsory military services. Supporters of conscientious objection are campaigning for the "right of conscientious objection" in line with the idea that there should be civilian public services as an alternative to compulsory military service. Turkey is not a party to the human rights convention that directly recognizes conscientious objection as a right. In the Article 72 of the 1982 Constitution act, which is titled 'National Service', principally an alternative to military service, civilian public service has also been provided. However, implementation of this law which provides a 'right' recognised in the Constitution, has been prevented by holding military service compulsory in Turkey with the law number 1111.
