INTRODUCTION TO JUDICIAL PROFESSION IN TURKISH LAW HISTORY AND COMPARATIVE LAW AND ASSİSTANT JUDGE

Özet

Hâkimlerin hukuka uygun karar verme yeteneğine sahip olan dürüst ve güvenilir kişiler arasından seçilmesi gerekmektedir. Zira hâkimlik ve hâkimin karar vermesinde etkili olan savcılık ve hâkim yardımcılığı meslekleri, ağır sorumluluk gerektirir. Bu mesleklerin nasıl daha iyi duruma gelebileceği geçmişte olduğu gibi günümüzde de hala önemini koruyan ve çözümler aranan bir konudur. Bu çalışmada geçmişten günümüze Türk hukukunda ve karşılaştırmalı hukukta hâkim olabilme şartları ve mesleğe giriş konusu incelenmiş, günümüze ışık tutması açısından mukayese edilerek çözüm önerilerinde bulunulmuştur. Bu bağlamda İslam ve Osmanlı hukukunda kadılık ve buna yardımcı meslekler, Cumhuriyet döneminde hâkimlik ve savcılık ile ilgili hukuki düzenlemeler ile karşılaştırmalı hukukta bu hususların nasıl düzenlenmiş olduğu ele alınmıştır.

Abstract

Judges should be selected from among honest and trustworthy individuals who have the ability to makedecisions in accordance with the law. Because the professions of the prosecution and deputy judges which areeffective in judging and the decision of the judge require heavy responsibility. How these professions can getbetter is still an important issue and solutions are sought in the past. In this study, the conditions of dominancein Turkish law and comparative law from the past to the present and the subject of entry to the profession wereexamined and solutions were proposed by comparing them in terms of shedding light on the present day. Inthis context, judicial and judicial professions in Islamic and Ottoman law, legal regulations related to judgeshipand prosecution during the Republican period and how these issues are regulated in comparative law arediscussed.
