Özet

Günümüzde, internet kullanımı dünyanın her yerine yayılmış ve bireylerin çok kısa sürede internete erişim sağlayabilmesi mümkün hale gelmiştir. Bunun neticesinde, internet ortamındaki hak ihlalleri artmıştır. Bu bağlamda kişisel verilerin korunması hakkının daha özel bir görünümü olan unutulma hakkı, yeniden tartışılmaya başlamıştır. Avrupa Birliği Adalet Divanı tarafından 13 Mayıs 2014 tarihinde verilen Google-Spain kararı, internetteki arama sonuçlarından bağlantı kaldırmayı sağlayan unutulma hakkının hukuken tanınmasını sağlamıştır. Sonuç olarak başta Google olmak üzere diğer arama motorları da unutulma hakkını uygulamakla yükümlü kılınmıştır. Unutulma hakkı, Google tarafından küresel olarak uygulanmamaktadır. Bir başka deyişle yalnızca talebin yapıldığı ülke ve Avrupa içerisinde uygulanmaktadır. Bu durum ise birçok eleştiri almıştır. Ayrıca unutulma hakkının ifade özgürlüğü hakkı ile çatışması nedeniyle uygulanmaması gerektiği konusunda da tartışmalar mevcuttur. Unutulma hakkı, yalnızca Avrupa Birliği ülkeleri arasında bağlayıcı bir haktır. Bununla beraber Avrupa Birliği üyesi olmayan ülkeler tarafından da rağbet görmektedir.

Abstract

Today, usage of the internet is spread all over the world and it became possible forindividuals to connect to the internet. Hence, abuses of the rights on the internet increased.In this sense, the right to be forgotten, which is a more special aspect of the right to protectionof the personal data, is started to be discussed again. Google-Spain decision made by theCourt of Justice of the European Union on 13 May 2014, ensured judicial recognition of theright to be forgotten, which allows the connection made by using research history to beremoved. Consequently, initially Google, all the internet browsers are also held responsiblefor judicial recognition of the right to be forgotten. The right to be forgotten is being appliedby Google globally. In other words, it is applied only in the country where the claim wasfiled and Europe. This situation drew a lot of criticism. There are also debates that the rightto be forgotten should not be implemented because of its conflict with the right to freedomof expression. The right to be forgotten, is a binding right among merely the European Unioncountries. Nevertheless, this right is in demand by non- European Union countries as well.
