Özet
Son yıllarda çalışma hayatı içerisinde adı sıklıkla duyulan Mobbing kavramı, iş yeri barışı ve istihdam edilenlerin adil şartlarda huzurla çalışmalarına yönelik en büyük sorundur. Her ne kadar konu İş Hukuku’nun ilgi alanı içerisinde görünse de mobbing mağduruna karşı ika edilen fiiller Ceza Hukuku açısından da haksızlık teşkil etmektedir. Bu sebeple Türk Ceza Kanunu içinde mobbing oluşturan sistematik davranışlara yönelik pek çok suç tipi bulunmaktadır. Bununla beraber Fransa hariç Kıta Avrupası Hukuk Sistemine dahil olan ülkelerin Ceza Hukuku mevzuatlarında bağımsız bir mobbing suçu düzenlenmemektedir. Türk Ceza Hukuku doktrini de buradan hareketle, kanunda ayrıca bir düzenleme yapma gereğine inanmamaktadır. Oysa söz konusu ülkelerde yargı uygulamacıları mobbing oluşturan davranışlara karşı bilinçli ve hassas olduklarından bu tip fiilleri Federal Ceza Kanunlarındaki ilgili hükümlerle cezalandırmaktadırlar. Oysa ülkemizdeki mahkeme uygulamalarında failin fiilinin mobbing oluşturduğuna dair bir gerekçeli karara rastlanamamaktadır. Her ne kadar bazı Yargıtay kararlarında azınlık görüşü olarak göze çarpsa da bu durum hızla değişmelidir. Çalışma Bakanlığının verilerine göre ülkemizde istihdam edilenlerin yaklaşık yüzde kırkının mobbinge maruz kaldığı gerçeği karşısında, Ceza Mahkemelerinin bu konuda bilinçlenmeleri büyük önem arz etmektedir.Bu çalışmamızda yargı uygulamamızın en az mobbing kavramı kadar kendini yabancı hissettiği ve az başvurduğu, TCK nun 96.maddesinde düzenlenen Eziyet suçu çerçevesinde mobbing kavramına büyüteç tutulmuştur. Çalışmanın sonunda da önerildiği üzere, Ceza Kanununda bağımsız bir mobbing düzenlemesi yapılması pek çok sorunu çözecektir kanaatindeyiz.
Abstract
The concept of mobbing, which is frequently heard in business life in recent years, is the biggest problem forworkplace peace and the peaceful work of the employed under fair conditions. Although the issue seems to bewithin the scope of Labor Law, the acts committed against the victim of mobbing constitute unfairness in terms ofCriminal Law. For this reason, there are many types of crimes in the Turkish Penal Code for systematic behaviorsthat constitute mobbing. However, an independent mobbing crime is not regulated in the Criminal Law legislationof the countries included in the Continental European Legal System, except for France. Based on this, the TurkishCriminal Law doctrine does not believe in the need to make a separate regulation in the law. In fact, since thejudicial practitioners in these countries are conscious and sensitive to behaviors that constitute mobbing, theypunish such acts with the relevant provisions in the Federal Criminal Laws. Besides that, in court practices in ourcountry, there is no reasoned decision stating that the act of the perpetrator constitutes mobbing. Although it standsout as a minority opinion in some Supreme Court decisions, this situation should change rapidly. According to thedata of the Ministry of Labor, it is of great importance for the Criminal Courts to be aware of the fact that aboutforty percent of those who are employed in our country are exposed to mobbing. In this study, the concept ofmobbing has been magnified within the framework of torment crime regulated in Article 96 of the Turkish PenalCode, which our judicial practice feels as alien as the concept of mobbing and applied less frequently. As suggestedat the end of the study, we believe that making an independent mobbing regulation in the Criminal Code will solvemany problems.
