Özet

Tanzimat ve sonrasındaki süreçte çalkantılı dönemler yaşayan Osmanlı Hukuk düşüncesinde Batı ile karşılaşmanın etkilerini iyiden iyiye görmek mümkündür. Gerek değiştirilmesi gündeme gelen yönetim şeklindeki arayışlar gerekse Batı kanunlarından yapılan resepsiyonlar devlet ricalinden mütefekkirlere kadar geniş bir kitlede yankı bulmuştur. Tartışmaların merkezindeki konulardan biri de şüphesiz bu yeni düzenlemelerin siyâset-i şer‘iyyeye uygunluğu ve şer‘î kanunlara ne derece yer verileceğidir. Bunun sonucunda farklı meşrep ve dünya görüşüne göre yazılan çok sayıda kitap, makale ve risaleden oluşan zengin bir literatür meydana gelmiştir. Özellikle II. Meşrutiyet sonrası meydana geldiği varsayılan rahatlama sonucu, Kanûn-i Esâsîgibi düzenlemeler başta olmak üzere bazı kanunların tartışılması için uygun bir ortam oluşmuştur. Dönemin aydınlarından İbnü’l-Hâzım Ferîd (ö. 1938), hem klasik medrese hem de hukuk eğitimi almış, yıllarca fiilen adliye teşkilatında görev yapmış, edebi yeteneği de olan çok yönlü bir Osmanlı aydınıdır. Çalışmamızda ele alacağımız İbnü’l-Hâzım’ın “Siyâset-i Şer‘iyye” yazı dizisi, bu dönemde şer‘î siyaset bağlamında tartışılan adalet, eşitlik ve hürriyet gibi bazı soyut konuları ele almıştır. Ancak bunlara nispetle, yürürlükte olan 1274/1858 tarihli Ceza Kanunnâme-i Hümâyunu’nun bazı maddelerinin tahliline daha çok yer vermiştir. Ayrıca adliye teşkilatında görülen aksaklıklar, muhakeme usulü ve istibdâd dönemi diye nitelediği süreçte yaşanan problemler de bu yazılarda gündeme getirilmiştir. Ferîd, siyâset-i şer‘iyyeyi merkeze alarak sık sık dönemin kanunlarıyla mukayese etmiş ve eksikliklerini dile getirmiştir. Batı kaynaklı bazı ticari uygulamaların ve aile hukukunun da incelendiği yazı dizisinin geniş içerikli muhtevası arasından, şer‘î siyasetin pratik uygulama alanını daha fazla temsil ettiğini düşündüğümüz hukuk felsefesi ve ceza hukuku konuları incelenecektir.

Abstract

It is possible to see the effects of encountering the West in Ottoman law thought, which experienced turbulentperiods during the Tanzimat and after. Both the seeking in the form of administration, which has come to the foreto be changed, and the adaptations made from Western laws resonated with a broad audience from state officialsto thinkers. Undoubtedly, one of the issues at the center of the discussions is the suitability of these newregulations to politics and the extent to which religious laws will be included. As a result, a rich literatureconsisting of many books, articles, and treatises written according to different theories and world views hasemerged, especially due to the relief that was supposed to have occurred after the II. Constitutional Monarchy, asuitable environment was created to discuss some laws, especially the regulations such as Qanun al-Asasi (theConstitution). Ibnu’l-Hazim Ferid (d. 1938), one of the intellectuals of the period, was a versatile Ottomanintellectual who had both classical madrasah and law education, actively worked in the courthouse for years, andhad literary talent. The article series "Siyâset-i Şer‘iyye" by Ibnü'l-Hazim, which we will discuss in our study,dealt with more abstract issues such as justice, equality, and freedom, which were discussed in the context ofreligious politics in this period. However, in relation to these, it gave more space to the analysis of some articlesof the Criminal Law of 1274/1858, which was more in effect. Besides, the judicial organization's problems, theprocedure of judgment, and the problems experienced in the process that he described as the period of deprivationwere also brought to the agenda in these articles. Ferîd often compared the laws of the period and expressed hisdeficiencies by focusing on politics. Among the wide-ranging content of the series of articles, in which someWestern-based commercial practices and family law are also examined, the issues of legal philosophy andcriminal law, which we think more represent the practical application of Islamic politics, will be examined.
