Özet
Bugünkü Millî Güvenlik Kurulunun selefi mahiyetindeki Yüksek Müdafaa Meclisi 24 Nisan 1933 gün ve 14443 sayılı Kararname ile; 10 Ağustos 1933 günü çıkarılan 14819 sayılı Kararnameyle de Yüksek Müdafaa Meclisi Umumi Kâtipliği ihdas olunmuştur. “Devlet işlerinin en başında gelen topyekûn Millî Savunma görevlerini yerine getirmek üzere” 30 Mayıs 1949 tarihinde Millî Savunma Yüksek Kurulu kurulmuş ve Kurul Yüksek Müdafaa Meclisinin yerini almıştır. Anayasal olarak “millî güvenlik” kavramı ise ilk defa 1961 Anayasası ile mümkün olabilmiştir. Temel hak ve hürriyetlerin kısıtlanması bakımından 1961 Anayasası’na kıyasla 1982 Anayasası’nda millî güvenlik kavramı savunma ve güvenlik konularını aşacak biçimde genişleyerek yer almıştır. 1982 Anayasası’nın 118. maddesi gereği 1 Kasım 1983 gün ve 2945 sayılı Millî Güvenlik Kurulu ve Millî Güvenlik Kurulu Genel Sekreterliği Kanunu ile Millî Güvenlik Kurulu kurulmuş ve 2017 yılında yapılan Anayasa değişikliği Kurul bugünkü yapısına kavuşmuştur.
Abstract
The Supreme Defense Council, which is the predecessor of the current National Security Council, with the Decree No. 14443 of April 24, 1933; With the Decree No. 14819 issued on 10 August 1933, the General Secretary of the High Defense Council was established. The National Defense Supreme Council was established on 30 May 1949 and took the place of the High Defense Council. Constitutionally, the concept of "national security" became possible for the first time with the 1961 Constitution. In terms of restriction of fundamental rights and freedoms, the concept of national security was included in the 1982 Constitution by expanding beyond the defense and security issues compared to the 1961 Constitution. In accordance with Article 118 of the 1982 Constitution, the National Security Council was established on November 1, 1983 and with the Law No. 2945 of the National Security Council and the General Secretariat of the National Security Council, and the Constitutional amendment made in 2017 gained its current structure.
