Özet
Öteden beri; mükellefler vergiyi ödememe, devletler ise vergiyi tahsil etme çabaları içindedirler. Bu doğrultuda mükellef vergi ödememek için, devlet mükelleften vergiyi almak için çeşitli yöntemler geliştirmiştir. İçinde bulunduğumuz yüzyılda; mükelleflerin birden fazla ülkede örgütlenmesi, dijital dünyanın hayatımızın her anına hükmetmesi sonucu ülkelerin sadece iç hukuklarında düzenlemeler yapması mükelleflerin vergi ödememe çabalarını engel olmamaktadır. Bunu sorunu önleyebilmek adına OECD, kısaca BEPS olarak adlandırılan “Base Erosion and Profit Shifting/Matrah Aşındırma ve Kâr Aktarımı eylem planlarını hazırlamış ve bu soruna devlet açısından değil; üye ülkeler açısından bakmak istemiştir. Bu çalışmada OECD-BEPS çerçevesinde matrah aşındırma ve kâr aktarımı ile ilgili alınan önlemler sıralanarak açıklanmıştır. Her bir eylem planı ile ilgili Türkiye’nin uyum süreci ve attığı adımlar incelenerek genel bir değerlendirme yapılmıştır.
Abstract
Since before now, taxpayers do not pay the tax; states are making efforts to collect the tax. In this direction, while taxpayer are trying not to pay taxes, the state has developed various methods for collecting taxes from the taxpayer. In the present century; Due to taxpayers are organized in more than one country and the digital world dominates every moment of our lives, making regulations only in the domestic laws of the countries does not prevent taxpayers from paying taxes. In order to prevent this, OECD prepared BEPS (Base Erosion and Profit Shifting) action plans and wanted to look at this problem from the point of view of member countries instead of a single state. In this study, the measures taken regarding base erosion and profit transfer are listed and explained within the framework of OECD-BEPS. A general evaluation was made by examining Turkey’s harmonization process and the steps taken regarding each action plan.
