Özet

Ülkemizde uygulanmakta olan Katma Değer Vergisi Kanununda Varış Ülkesinde Vergilendirme (Destinasyon İ lkesi) benimsenmiş tir.Bu ilkeye göre mal ve hizmetler nihai olarak tüketildiği ya da faydala-nıldıkları ülkede katma değer vergisine tabi tutulmalıdır. Türk KatmaDeğer Vergisi Kanununda destinasyon ilkesine uygun olarak mal vehizmet ihracatı katma değer vergisine tabi bulunmamaktadır. Bu nedenleTürkiyede ikamet etmeyenlerin Türkiyeden satın alıp kendi ülkelerinegötürdükleri mallar üzerindeki katma değer vergisi yükünün ortadankaldırılması destinasyon ilkesinin bir gereğidir. Kısaca yolcu beraberieş ya istisnası olarak ifade edilen bu istisna uygulaması ile ilgili yasaldüzenleme Katma Değer Vergisi Kanununun 11. maddesinin 1/b ben-dinde yapılmış tır. Bu düzenlemeye göre; Türkiyede ikamet etmeyenyolcular Türkiye dış ına götürecekleri malları satın alırken katma değervergisi ödenmekte, fakat daha sonra ödenen bu katma değer vergisi ma-lın gümrükten çıkı ı sırasında iade edilmektedir.

Abstract

Under the Added Value Tax Law applicable in Turkey, Taxationat the Destination Point (Destination Principle) has been adopted.According to this principle, goods, and services must be taxed at thedestination country, where they shall be finally consumed, or benefittedfrom. In accordance with the principle of destination, there is no valueadded tax on export of goods, and services under the Turkish AddedValue Tax Law. Therefore, lifting off the burden of added value tax onthe goods purchased, and taken to the home country by the non-residents, is by operation of the principle of destination. This regulationnamed Accompanying Baggage Exemption in brief, is regulated underArticle 11, subsection 1/b of the Added Value Tax Law. Under this law,passengers who do not reside in Turkey, pay added value tax for theitems they purchase, but the amount of this value added tax isreimbursed to them at the time of going through customs.
