Özet

Rehin hakkı sahibi, rehinli malın satılarak elde edilen paradan alacağını tahsil etme hakkına sahiptir. Bu şekilde borçlunun tasarruf yetkisine bir sınırlandırma getirilmektedir. Zira alacaklı rehinli malın satılmasını talep edebilmektedir. Bunun için alacaklının rehnin paraya çevrilmesi yolu ile takip yapması gerekmektedir. Ancak rehnedilmiş taşınmaz, rehnin paraya çevrilmesi yoluna girişen alacaklının alacağına yetmez ise bu durumda alacaklı kalan alacak miktarı için haciz yolu ile veya iflas yolu ile takip yapabilmektedir. Ayrıca mevzuatımızda belirlenen istisnai durumların varlığı halinde de alacaklı diğer takip yollarına başvurabilir. Eğer istisnai bir durum yoksa veya rehinli mal alacaklının rehne konu alacağını karşılamışsa alacaklı rehnin paraya çevrilmesi yolu ile takip dışındaki yollara başvuramayacaktır. Alacaklının rehnin paraya çevrilmesi yoluyla takip dışındaki yollara başvurması halinde önce rehne baş- vurma kuralı ihlal edilmiş olacaktır. Bu çalışmada taşınmaz rehninin paraya çevrilmesinde uygulanan kural ve istisnalar incelenerek nasıl bir prosedür izlendiği sorusuna yanıt aranmıştır.

Abstract

The owner of the pledge has the right to collect her receivables from the money obtained by selling the pledged goods. In this way, a limitation is imposed on the debtor's power of savings. Because the creditor can demand the sale of the pledged goods. For this, the creditor must follow up by converting the pledge into cash. However, if the pledged immovable is not sufficient for the creditor's receivables, who attempt to convert the pledge into cash, then the creditor can pursue the remaining amount of the receivable through foreclosure or bankruptcy. In addition, in the presence of exceptional situations determined in our legislation, the creditor may apply to other proceedings. If there is no exceptional situation or if the pledged property meets the pledged property, the creditor will not be able to resort to methods other than proceedings by converting the pledge into money. In the event that the creditor resorts to methods other than proceedings by converting the pledge into cash, the rule of applying for the pledge first will be violated. In this study, an answer was sought to the question of what kind of procedure was followed by examining the rules and exceptions applied in the conversion of immovable pledges into money.
