Özet
Bir yıldan fazla bir süredir tüm dünyayı kasıp kavuran Covid 19, günlük hayatımızın yanı sıra çalışma hayatımızın da değişmesine yol açtı. Virüsün bulaşıcı ve öldürücü etkisinden uzak kalabilme uğruna birçok işveren ya da işyeri eleman sayısını azaltma ve evde çalışması mümkün olanları evden çalışmaya göndermiştir. Doğaldır ki, bu tür bir çalışma beyaz yakalı işçiler için mümkünse de, üretim araç ve gereçleriyle yüz yüze çalışması gereken mavi yakalı işçiler için pek mümkün değildir. Aslında evden çalışma uzaktan çalışmanın yani işyeri dışında çalışmanın iki türünden biridir. Biri yüzyıllardır uygulanagelen ve işin evde yapılması esasına dayalı evde çalışma (ki buna geleneksel evde çalışma diyebiliriz) diğeri ise teknolojik yönden gelişmiş iletişim araçları (internet, computer, akıllı telefon vs.) kullanarak evden veya işyeri dışında bir başka yerden çalışmadır. Buna evden çalışma ya da artık tüm dillere yerleşmiş olduğu şekliyle “home office” denmektedir. Bu tür çalışmaya pandemi nedeniyle geçilmesi gerekiyor ise işverenden gelen böyle bir talebi işçinin reddetme hakkı yok denecek kadar azdır. Burada iş şartlarında değişiklik yapma nedeni değil bir zorunluluk hali bulunmaktadır. İşçi bu öneriyi kabul etmek zorundadır. Evden çalışmadaki en büyük handikap işçinin çalışmasının işverence denetlenip yönlendirilmesine ilişkin zorluktur. Ancak bu zorluklar görüntülü iletişim araçlarının yardımıyla en aza inebilmektedir. Görüntü sayesinde hem denetim yapılabilmekte hem de bağımlılık unsuru zayıflamış olsa dahi iş devam etmektedir. Bu makalede bu tür çalışma kavramı, ihtiyaçlar ve tarafların hak ve yükümlülükleri ele alınmıştır.
Abstract
Covid 19 pandemic has devastated and urged to change our daily life and working life as well. In order to keep away from the contegious and fatal effect of Covid 19, many firms and employers sacked some of their employees or urged them to work from home. Many employees accepted this offer with pleasure for the sake of their health. Of course working from home must be compatible with the type of the activity. It fits to white collar workers but unfits to blue collar workers due to the necessity that the work must be done face to face with using the machinery, tools, raw material etc. There are 2 types of working at home. One is the traditional type so that the work is carried out at home for the benefit of the employer. The other type of working from home is carried out at home but using the technological communication instruments such as internet, computer, smart phone etc. The latter type of work is called home office. Home office work can also be carried out somewhere else than home. Both type of work are the sorts of telework or remote work. We, in this article handled the latter type of tele work: Home office. During the last one year, many employers asked their employees to keep on working from home in order to keep them away from the contagious and fatal effect of the virus. This situation created a force majeur. With regard to law the employees have nowadays almost no right to reject this offer. In the normal time this kind of offer is considered a change of working conditions and this offer is up to the employees acceptance. But now, the conditions are different and bear fatal risks. The biggest handicap of the working from home is how to conduct and inspect the employees. This cause the weakening of the dependence relation between the employer and employee. However this handicap doesn’t create a big trouble. Because the employer has possibilities to check the workers with the visual facilities of the computers. Although the dependence relation between the employer and employee weakens it still continues within the employers work organisation. In this article we try to handle the concept of home work, requirements, necessities, and the rights and duties of the partners.
