Özet

İnceleme konusu Yargıtay 2. Hukuk Dairesi'nin 17.2.2010 tarihli ve E.2009/22118 K.2010/2791 sayılı kararında, eşlerden birinin evlilik birliğinin giderlerine katılma yükümlülüğünü yerine getirmemesi halinde, Türk Medenî Kanunu'nun 198. maddesi uyarınca hâkimin evlilik birliğinin giderlerine katılma yükümlülüğünü yerine getirmeyen eşin borçlularına ödemeyi tamamen veya kısmen diğer eşe yapmalarını emredebileceği ancak bu tedbirin yalnızca eşlerin ayrı yaşaması halinde uygulanabileceği belirtilmiştir. Ancak bu değerlendirme, hukuken hatalıdır. Çünkü bu önlemin alınabilmesi için, eşler tarafından birlikte yaşamaya ara verilmiş olması şart değildir. Borçlulara talimat verme önlemi, eşlerin birlikte yaşayıp yaşamadığına bakılmaksızın alınabilecek önlemlerdendir. Önemli olan eşlerden birinin evlilik birliğinin giderlerine katılmaması, bu yükümlülüğünü ihlal etmesidir

Abstract

In the judgment of the 2nd Civil Chamber of the Cassation Court (Date of Judgment: 17.2.2010, Reg. No. 2013/3434 Judgment No. 2010/2791), it has been stated that according to article 198 of Turkish Civil Code if a spouse fails to fulfil his or her duty to maintain the family, the court may order his or her debtors to make payment in full or in part to the other spouse only when the spouses live apart. However, the judgment is legally wrong since living apart is not a requirement for ordering the debtors. Ordering the debtors is one of the measures that can be taken regardless of whether the spouses live together. The important point is failing to fulfil the duty to maintain the family
