Özet

Ölüden gerçekleştirilecek organ ve doku nakillerinde doğaldır kiverici ölüdür. Ancak ölüm anının tespiti, bu amaçla da ölümün tanım-lanması sorunsalı çıkmaktadır. Zira bu konuda bazı tartışmalar bulun-maktadır. Bir kısım eser ve çalışmalarda naklin ölüm anı gerçekleşme-den yapıldığı bu sebeple de aslen kadavradan naklin mümkün olmadığıbelirtilmektedir. Hatta beyin ölümü gerçekleştiği belirtilen hastalar için“kalbi atan kadavra” deyimi dahi kullanılmaktadır. Bu eleştiriler ışığındabakıldığında kişinin verdiği rıza veya yakınları tarafından verilen rızanınmuteberliği de tartışma konusu olmaktadır.

Abstract

It is obivious that the donor is dead in organ and tissue transplan- tation to be performed from a dead donar. However, the determination of the moment of death and the determination of death for this purpose are problematic, as there are some debates on this subject matter. In some works and studies, it is stated that the transpantation from cadaver is not possible because of the fact that the death was not realized. Even the term "beating heart cadaver" is used for patients who have brain death. In light of these critiques the validty of the consent provided by the individiual or by its relatives wii also ve the subject of the discussions.
