SERMAYE PİYASASI KANUNU’NDA DÜZENLENEN KABAHATLER*

Özet

Sermaye piyasası, ekonomik olarak kendi kuralları olan bir düzen olup sermaye piyasasına ilişkin kurallar, suçlar ve kabahatler 6362 sayılı Sermaye Piyasası Kanunu’nda düzenlenmiştir. Kanun, sermaye piyasa-sına ilişkin genel kurallara yer verdikten sonra bazı suç tipleri ve kaba-hatleri de düzenlemiştir. Çalışmada öncelikle genel olarak kabahatlerden bahsedilecek son-rasında ise Sermaye Piyasası Kanunu’nda düzenlenen kabahatler ele alınacaktır. Sermaye Piyasası Kanunu hükümleri ele alınırken Kabahat-ler Kanunu hükümlerinin geçerli olduğu hususlar ile iki Kanun’un farklı düzenlemeler getirdiği durumlar ayrıca belirtilecektir. Ayrıca Sermaye Piyasası Kanunu’nda kabahatlere ilişkin olarak 2020 yılında yapılan değişiklikler ele alınacaktır.

Abstract

The capital market is an economic order with its own rules. This rules, crimes and misdemeanors against the order of capital market are regulated in the Capital Markets Law No. 6362. After the Law included the general rules regarding the capital market, it also regulated some types of crimes and misdemeanors. In the article, first of all, misdemeanors will be mentioned in gen-eral, and then the misdemeanors regulated in the Capital Market Law will be discussed. While discussing the provisions of the Capital Markets Law, the issues in which the general provisions of the Misdemeanor Act are valid and the situations where the two Laws bring different regulations will be specified separately. In addition, the amendments made in the Capital Market Law in 2020, regarding misdemeanors, will be discussed.
