Özet

Son zamanlarda sıklıkla gündeme gelen ve kullanımı yaygınlaşan popülizm kavramı, birçok tartışmaya ve çalışmaya konu olmaktadır. Popülizme ilişkin yapılan çalışmalarda popülizmin etki alanının, devlet- lerin sosyoekonomik yapısı ile etkin siyasi makamlardaki liderlerin rolü- ne bağlı olarak değişkenlik gösterdiği görülmektedir. Bu değişkenliğin günümüze en önemli yansıması ise insan hakları hukukuna yöneliktir. Popülizmin, insan haklarını açıkça reddetmemekle birlikte kavramı ken- di ihtiyaçları doğrultusunda yorumlayarak oldukça seçici ve araçsal bir yaklaşım benimsediği görülmektedir. Bu yaklaşım, artan sayıda ülkede popülist rejimlerin yükselişi ile insan hakları doktrinin son yarım yüzyıl- da kaydettiği ilerlemenin yeni ve farklı zorluklarla karşı karşıya kalma- sına ve insan haklarının önemli bir tehdit altında olmasına neden olmak- tadır. Bu çalışmada, söz konusu güncel popülist dalganın, insan hakları hukukuna ve özellikle Avrupa İnsan Hakları Mahkemesi kararlarının uygulanmasına etkisi, ileri sürdükleri eleştirel argümanlar çerçevesinde incelenecektir.

Abstract

The concept of populism, which has recently come to the fore and its use has become widespread, has been the subject of many discussions and studies. In these studies, it is seen that the scope of populism varies depending on the socioeconomic structure of the states and the role of the leaders in effective political positions. One of the most important areas in which the results of this variability show themselves is human rights law. Although populism does not explicitly reject human rights, it is seen that populists adopt a very selective and instrumental approach by interpreting the concept in line with their own needs. This approach, with the rise of populist regimes in an increasing number of countries, create new and different challenges for the progress of the human rights doctrine in the last half century and put human rights under a significant threat. In this study, the effects of this current populist wave on human rights law and especially on the implementation of the judgments of the European Court of Human Rights will be examined within the frame- work of populist critical arguments.
