Özet

Çalışanların güvenliği ve sağlığı ile çalışma ortamı arasında iki yönlü bir etkileşim bulunmaktadır. İş sağlığı ve güvenliği ile ilgili ön-lemlerin alınması, işverenin hukuken işçiyi gözetme borcu kapsamındaki temel yükümlülüklerdendir ve bu kapsamda işveren, işyerinde çalışanın yaşam ve sağlık hakkının korunması için gerekli tüm önlemleri almakla yükümlüdür. İşverenler işçiyi gözetme borcuna aykırılık teşkil edecek şekilde, iş sağlığı ve güvenliği yükümlülüklerini gerçekleştirmediği tak-dirde meydana gelen iş kazası nedeniyle yaralanma ve ölüm sonucunda hukuki, idari ve cezai sorumluluk altına girmektedir. Cezai sorumluluk esasen taksirden kaynaklanan sorumluluk olup, işverenler iş kazaları neticesinde taksir, bilinçli taksir ve olası kastla yaralama ve ölüme sebe-biyet vermekten sorumlu tutulmaktadır. Çalışma kapsamında iş sağlığı ve güvenliği kapsamında iş yaşamında gerçekleşen kazaların cezai de-ğerlendirmesinin yapılması amaçlanmıştır.

Abstract

There is an interaction between the safety and health of the em-ployees and the working environment. Taking precautions for occupa-tional health and safety services within the scope of legal worker super-vision is one of the basic obligations and employers must take all pre-cautions in this context within the scope of occupational health. If the employers do not fulfill their occupational health and safety obligations in violation of the worker's duty of supervision, they are under legal, administrative and penal liability as a result of injury and death due to occupational accidents. Criminal liability is essentially the responsibility arising from negligence, and employers are held responsible for causing injury and death through negligence, conscious negligence and dolus eventualis as a result of occupational accidents. Within the scope of the study, it is aimed to evaluate the legal, administrative and penal respon-sibilities of the employer from the injuries and deaths that may occur as a result of the negativities that may be experienced in occupational health and safety
