Özet

Eşlerden birinin ölümü hem mal rejimleri hukukunda hem de mi- ras hukukunda bazı hukuki sonuçların doğmasına neden olmaktadır. Sağ kalan eşin katılma alacaklısı ya da borçlusu olması durumuna göre mi- rasçıların miras paylarının miktarı önemli ölçüde değişmektedir. Sağ kalan eşin ölen eşten katılma alacağı olması hâlinde, sağ kalan eş katıl- ma alacağının hem alacaklısı hem de mirasçı sıfatıyla borçlusu konu- munda olmaktadır. Ölen eşin, sağ kalan eşe karşı katılma alacağının ol- ması hâlinde ise sağ kalan eş katılma alacağının hem borçlusu hem de mirasçı sıfatıyla alacaklısı olmaktadır. Özellikle katılma alacağı bakı- mından sağ kalan eşte alacaklı ve borçlu sıfatlarının birleşmesi ve tere- kenin borcundan mirasçıların müteselsilen sorumlu olmaları meseleleri uygulamayı güç hâle getirmektedir. Bu çalışmada sağ kalan eşin katılma alacağının; mal rejimi hukuku bakımından alacaklısı, miras hukuku ba- kımından ise borçlusu olmasının uygulamada ortaya çıkardığı problem- er; matematiksel hesaplamalarla birlikte doktrindeki görüşler ve yargı kararları ile açıklanmaya çalışılacaktır.

Abstract

The death of one of the spouses has some legal consequences both in the law of matrimonial property regimes and in the law of inheritan- ce. Depending on whether the surviving spouse is a participation credi- tor or debtor, the amount of the inheritance shares of the heirs varies considerably. Where the surviving spouse having a participation claim from the deceased spouse, the surviving spouse becomes both the credi- tor and the debtor of the participation claim as a heir. If the deceased spouse has a participation claim against the surviving spouse, the survi- ving spouse is both the debtor and the creditor of the participation claim as a heir. Particularly in terms of participation claim, the matters of the combination of the titles of creditor and debtor in the surviving spouse and the joint responsibility of the heirs for the debt of the estate make the practice difficult. This study explains the problems that arise in practice where the surviving spouse is the creditor of the participation claim in terms of matrimonial property regime law and the debtor of the partici- pation claim in terms of inheritance law using mathematical calculations.
