UZAKTAN ÇALIŞMADA İŞ SAĞLIĞI VE GÜVENLİĞİNİN SAĞLANMASI

Özet

Sanayileşmeyle beraber fordist üretime geçilmesi, teknolojik gelişmelerle birlikte karmaşıklaşan çalışma hayatı, bu karmaşıklığın sonucu olarak artan iş kazaları ve meslek hastalıkları iş sağlığı ve güvenliğiyle ilgili birçok önlemin alınması ihtiyacını doğurmuştur. Çalışanın vücut bütünlüğü ve hayatını korumaya dair olarak yapılan iş sağlığı ve güvenliği önlemleri birçok yasal düzenlemenin de konusunu oluşturmuştur. Bilgi iletişim teknolojilerinin gelişmesi neticesinde çalışma hayatında sıklıkla duyulmaya başlanan uzaktan çalışma (tele çalışma) kavramı, olumlu ve olumsuz yönleri ile değerlendirilmeye başlanmıştır. Değerlendirme konularından biri de işverenin, uzaktan çalışmada iş sağlığı ve güvenliği yönünden her türlü önlemi alma yükümlülüğünü nasıl yeri ne getireceği hususudur. Başka bir ifadeyle uzaktan çalışmada iş sağlığı ve güvenliği önlemlerinin çalışma ortamına nasıl uyarlanacağıdır. Çalışmamızda bu kapsamda yapılan değerlendirmeler, ilgili mevzuat ve düzenlemeler ele alınmış; uzaktan çalışanın sebebiyet verebileceği muhtemel tehlikeler tespit edilmeye çalışılmıştır. Neticede gittikçe yaygınlaşan uzaktan çalışma modeline ilişkin daha ayrıntılı hukuki düzenlemelere ihtiyaç olduğu sonucuna varılmıştır. Ulaşılan veriler ışığında çözüm önerileri geliştirilmeye çalışılmıştır.

Abstract

The transition to machinery with industrialization, the working life that has become more complex with simple production, the work accidents and occupational diseases that occur from this complex process consist of a multi-planned planning for occupational health and safety. The regulations for the body of the vehicle and for the employees also constitute a review of the revised regulations of the occupational health and safety. With the development of information and communication technologies, the concept of remote work, which has been heard frequently in working life, has started to be discussed with its positive and negative aspects. One of these discussions is how the employer will fulfill its responsibility to take all kinds of measures in terms of occupational health and safety. In other words, it is the issue of how to adapt occupational health and safety measures to the working environment in remote working. Studies carried out in this context, relevant legislation and regulations were examined; The possible risks, diseases and dangers created by the remote worker were tried to be determined. It has been concluded that there is a need for more detailed legal regulations in the form of this study, which has become increasingly widespread. In the light of the obtained data, solution suggestions were tried to be developed.
