Özet
“Suç şüphesi”, işverenin haklı nedenlerinin düzenlendiği İşK m. 25’te açıkça ifade edilmemiştir. Ancak “işçinin gözaltına alınması veya tutuklanması halinde devamsızlık” İşK m. 25/IV’de haklı neden olarak düzenlenmiştir. Bu düzenlemede temel neden devamsızlıktır; ama devamsızlık gözaltı ya da tutukluluktan kaynaklanmıyorsa işveren İşK m. 25/IV’e dayanarak iş sözleşmesini feshedemeyecektir. Dolayısıyla işçinin gözaltına alınması veya tutukluluğu ve bunların temelini oluşturan suç şüphesi, iş sözleşmesinin haklı nedenle feshedilmesine yol açabilmektedir. 1475 sayılı İş Kanunu’nda 4857 sayılı İş Kanunu m. 25/IV’deki gibi bir düzenleme bulunmuyordu. 4857 sayılı İş Kanunu’nda “işçinin gözaltı veya tutukluluktan dolayı devamsızlığı nedeniyle fesih” in açıkça düzenlenmesi işçiler açısından olumlu bir gelişme olmuştur. Çalışmamızda, olumlu bir gelişme olarak nitelendirilebilecek İşK m. 25/IV ele alınacak ve işçinin suç şüphesi sonucu meydana gelmiş bir fesih yüzünden yaşayabileceği mağduriyetler doğrultusunda “de lege ferenda” bakımından incelenecektir.
Abstract
Criminal Suspicion is not clearly stated in Labour Law Article 25 regulating just causes of Employer. However, “absenteeism in case the employee is detained or arrested” is regulated as a just cause in Labour Law Article 25/IV. The main reason for this arrangement is absenteeism; but if the absenteeism does not arise from detentions, the employer will not be able to terminate the employment contract based on Labour Law Article 25/IV. Hence, detentions of employee and criminal suspicion underlying them can lead to termination of employment contract for just cause. Labour Law No 1475 did not contain a regulation as in Labour Law No 4857 Article 25/IV. In Labour Law No 4857, the clear regulation of “termination owing to the employee's absenteeism that is arised from detentions” has been a positive development for employees. In our study, Labour Law m. 25/IV that can be described as a positive development, will be discussed and will be examined in terms of "de lege ferenda" in line with victimization that the employee may experience due to a termination that has occurred because of criminal suspicion.
