Özet
Dünya Ticaret Örgütü (DTÖ) anlaşmazlık mutabakat metninin 3. Maddesine gore Uyuşmazlık çözüm sistemi DTÖ’nün merkezinde yer alan bir sistem olarak hukuki metinlerde yer alan hak ve sorumlulukları azaltamaz ve arttıramaz. DTÖ’nün muğlak anlaşma hükümlerine, bu hükümlerin oluşturduğu hakları ve sorumlulukları arttırıp azaltmadan yorum yapabilmesi ne ölçüde mümkündür, ve bunu yaparken Dünya Ticaret Örgütü uyuşmazlık çözüm sistemi, yaratıcılık rolü ve koruyuculuk rolü arasındaki dengeyi nasıl oluşturucak. Uyuşmazlık çözüm sisteminin süreci, hedefi, yorumlamalardaki zorluklar, yorum prensipleri ve kuralları, hukuki hükümlerin anlamlarını açıklamada önemli bir yer tutmaktadır.Uyuşmazlık çözüm sisteminin bu iki rolü arasındaki dengeyi nasıl kurduğu makalede açıkça görülebilecektir.
Abstract
It states in Article 3 of Understanding on Rules and Procedures Governing the Settlement of Disputes that the dispute settlement system of the WTO is a central element of to the multilateral trading system and recommendations and rulings of the DSB cannot add to or diminish the rights and obligations provided in the covered agreements.To what extend it is possible to interpret covered agreements of WTO in an attempt to clarify their meaning without diminishing or adding any rights and obligations the legal texts generate, and how does the dispute settlement system keep balance between its creative interpretative role and its conservative preservative role. The dispute settlement system process and objects, difficulty of interpretation, interpretation principles and rules which are important for Dispute Settlement system when they clarify legal texts meaning are considered in this article. It will be seen cleary in this article how Dispute settlement system tries to keep balance between these two roles.
