Özet
Futbol endüstrisinin gelişmesiyle birlikte, günümüzde futbol sadece bir sportif etkinlik olarak görülmemektedir. Milyar dolarlık bir sektör olarak futbol, tüm dünyadan milyonlarca insanı kendine çekmektedir. Futbolun esas aktörleri olarak futbolcular, 1900’lü yıllardan bu yana tüm dünyada sendikalaşmaktadırlar. Öte yandan, Türkiye liglerinde oynayan futbolcular açısından etkin bir futbolcular derneğine veya sendikasına ihtiyaç vardır. İngiltere, İtalya, İspanya ve Portekiz’deki benzerlerinin aksine, Türkiye Profesyonel Futbolcular Derneği (TPFD) etkin olmaktan uzaktır. TPFD’nin başarısızlığını açıklamak için birçok neden ve mazeret bulunmaktadır. Bu makale, TPFD’nin mevcut yasal pozisyonunu belirlemeyi, TPFD’ye engel yaratan temel hukuki sorunları ortaya koymayı, Türk futbolunun neden etkin bir futbolcular derneğine ihtiyaç duyduğunu açıklamayı ve TPFA’ya etkinlik kazandırabilmek için hangi yasal düzenlemelerin göz önünde bulundurulması gerektiğini belirlemeyi amaçlamaktadır. Söz konusu amaca ulaşabilmek için makale boyunca UEFA, FIFA, Türkiye Futbol Federasyonu ve Türkiye’deki yasal düzenlemelere atıfta bulunulacaktır.
Abstract
With the development of football industry, today, football is not regarded as only a sporting event. It is a billion dollar sector which attracts millions of people all over the world. As the main actor of football, footballers have long been unionized throughout the world since 1900s. On the other hand, with regard to the footballers playing in the Turkish Leagues, there is a need for an effective footballers’ association or a union. Unlike its counterparts in England, Italy, Spain, Germany, or Portugal; Turkish Professional Footballers’ Association (TPFA) is far from effectiveness. There are so many reasons and excuses for TPFA to explain its lack of success. This article aims to identify the current legal position of TPFA, to set forth the legal issues which create obstacles for TPFA, to explain why Turkish football needs an effective footballers’ association and to determine which legal regulations should be considered in order to give an effect to TPFA. In order to achieve these goals, UEFA, FIFA, Turkish Football Association, and Turkish legislation will be referred throughout the article.
