XIX. YÜZYILIN İLK YARISINDA NİKSAR KAZASINDA MÂLİKÂNE-DİVÂNÎ SİSTEMİ ÜZERİNE BAZI DEĞERLENDİRMELER

Some Evaluations about the Mâlikâne-Divânî System in the District of Niksar in the First Half of the 19th Century

Özet

Osmanlı arazi hukuku hakkındaki çalışmalara katkıda bulunmak amacıyla hazırlanan bu makalede, gelirlerin bir bölümünün mâlikâne hissesi olarak özel şahıslara veya vakıflara, diğer bölümünün ise divânî hissesi olarak devlete ait sayıldığı mâlikâne-divânî sistemi, Niksar kazası üzerinden incelenecektir. Yörede mâlikâne-divânî sisteminin timar sistemi ile iç içe geçen yapısı, konunun timar sistemi ile birlikte ele alınmasını zorunlu kılmaktadır. Bu sebeple askerî ve idarî düzen açısından olduğu kadar toprak idaresi bakımından da önemli görevler yüklenen timar sisteminin durumu da ele alınacaktır. İncelenen kayıtlar, XIX. yüzyılda mâlikâne-divânî sisteminin aldığı vaziyet yanında, timar sisteminin işleyişi ve durumu hakkında da önemli bilgiler vermektedir. Bu amaca yönelik olarak ilgili belgeler incelenerek konu ile ilgili tespitlerde bulunulmuştur.

Abstract

This article presents mâlikâne-divânî system in order to contribute to the studies on the Ottoman land law. Within this mâlikâne-divânî system, and some revenues of which belong to private people or vaqfs as a mâlikâne share and others to the state as a divânî share, will be analyzed with regard to the District od Niksar. The coexistence of Mâlikâne-divânî and Timar system requires these topics to be evaluated together. As a result, the condition of the timar system which has important duties in terms of not only military and administrative order but also land administration system will also be discussed. The records analyzed give important information on the operation and the status of the timar system as well as showing the status of the mâlikâne-divânî system in the 19th century. For tihs purpose, related documents about the topic have been analyzed and observations have been made.
