Özet

Fikri mülkiyet haklarını düzenleyen TRIPs Sözlesmesiyle ilaçlara getirilen patent koruması rejiminin, bir insan hakkı olarak saglık hakkının korunması ve ilaçlara erisimde çıkardıgı engeller son yılların sıkça tartısılan konularından birisidir. Tartısmaların merkezinde iki karsıt argüman yer almaktadır. Bir kesim, patentin bulus sahibinin fikri mülkiyet hakkını korudugu ve onun yeni ilaçlar için arastırma-gelistirme faaliyetlerine imkan tanıdgı gerekçesiyle ilaçta patent uygulamasını savunmaktadır. Diger bir kesim ise, temel ilaçlar olarak adlandırılan ilaçlarda patent uygulamasını çesitli insan hakları belgeleriyle güvence altına alınan bir baska insan hakkının, saglık hakkının korunması ve gelistirilmesinde bir engel olarak görmektedir. Saglık hakkını bir insan hakkı olarak savunanlar bu hakkın güvence altına alınmasında temel sorumlulugu devletlere yüklemektedir. Buna göre, devletler bu hakkın asli unsuru olan temel ilaçlara erisimi her yurttas için saglamalıdır. Genelde saglık hakkının, özelde de temel ilaçlara erisim hakkının çok boyutlu olması ve ülkelerin ekonomik kalkınmıslık derecesiyle yakından ilgili olması çözüme yönelik çabalarda engeller yaratmaktadır. Yazarlara göre de, saglık hakkının sözde kalmaması için temel sorumluluk devletlere ve bu devletlerin ilgili kurum ve kuruluslarına aittir. Bununla birlikte, bu Çalısmada, saglık hakkının vazgeçilmezi olan temel ilaçlara erisim hakkından herkesin faydalanmasında sorunun basat tarafı olan ilaç firmalarının birtakım etik yükümlülükler üstlenmesinin çözüme önemli katkılar saglayacagı vurgulanmaktadır.

Abstract

Patent regime for medicines that is established by TRIPs Convention that governs the intellectual property rights leads to certain obstacles for the protection of the Right to Health Care as one of the Human Rights and for the access to medicines. This obtacle is one of the hotly debated topics in recent years. Two opposing arguments are at the centre of the ongoing discussions. The first perspective claims that patents protect intellectual property rights of the inventors and help them to develop new medicines. Second perspective asserts that patent protection, for some essential medicines at least, is an obstacle to protect and further the right to health, that is one other human rights and is secured by certain human rights protocols. Those who argue that right to health is part of the human rights claim that states should have the responsibility to protect these rights. According to this, states should ensure the access of all citizens to the essential medicines that is a main component of the right to health. The multi-dimensionality and development level dependent nature of the right to health and the right to access the medicines creates extra obstacles for the resolution of the problem. The authors of this article also thinks that for the realization of the right to health, main responsibility should be held by the states and its relevant institutions. Nevertheless, in this study it is emphasised that to give some responsibility to the pharmaceutical companies which are the center of the problem would make significant contributions to the resolution of the problem.
