Özet

Telekomünikasyon hizmetleri evrensel hizmet kavramı içerisinde yer alırlar. Bunedenle, bu hizmetler, bir düzenleyici ve denetleyici kurum olan Bilgi Teknolojileri ve İletişim Kurumu’nun (BTK) görev alanındadır. İşletmeciler Kurum’un mevzuatı ve kendisinin oluşturduğu kurallar çerçevesinde hizmet etmek üzere yer alırlar. Dolayısıyla işletmeciler arasında uyuşmazlıkların çıkması kaçınılmazdır.2008 yılı sonunda yürürlüğe giren 5809 sayılı Elektronik Haberleşme Kanunu,hem telekomünikasyon alanını hem de bu alanda ortaya çıkan uyuşmazlıkların çözüm yollarını düzenler. İşletmeciler arasındaki uyuşmazlıkları barışçıl yollarla çözme yetkisi BTK’ya verilmiştir. BTK, bu yetkisini uzlaştırma usulü ile kullanır. Çalışmamızda,BTK’nın uzlaştırma yetkisinin hukuksal dayanakları, uzlaştırma yoluna kimin, nasıl ve hangi sürede başvuracağı, BTK’nın nasıl karar vereceği ve bu kararın nasıl bir sonuç doğuracağı ayrıntılı bir şekilde incelenmiştir.

Abstract

Telecommunication services are included in the concept of universal services.Therefore, these services are under the scope of the Information and Communication Technologies Authority (ICTA) as a regulatory and supervising organization. Managers participate in the service within the framework of the rules and legislation of the Authority. Accordingly, it is inevitable that there are disputes between the managers. The Electronic Communication Code numbered 5809 that came into effect at the end of the year 2008 prescribes both the domain of the telecomunication sector andthe resolutions of the disputes in this sector. The competence of the dispute resolution in a reconciliatory way between the managers is granted to ICTA. ICTA exercisesthis power upon the procedure of conciliation. In our paper, the legal resources of the conciliation competence of ICTA; by whom, how and when it would be applied, how ICTA would come to an award, and the consequences of this award are analyzed in a detailed manner.
