Özet

İnsan haklarına ilişkin diğer temel belgelere kıyasla, Amerikan İnsan Hakları Sözleşmesi, ifade özgürlüğünü oldukça detaylı bir şekilde düzenlemiştir. Sözleşmenin yargısal denetim organı olan Amerikalılar-arası Mahkeme, kararları ve tavsiye görüşleriyle, ifade özgürlüğünün kapsamını geniş, bu özgürlüğe getirilebilecek sınırlamaları dar yorumlamıştır. Kısa zamanda zengin ve tutarlı bir içtihat oluşturan Mahkeme, ifade özgürlüğünü yalnızca bireysel değil, aynı zamanda kendisine önemli misyonlar yüklenen sosyal ve kültürel bir hak olarak ele almıştır. Özellikle, bilgi edinme hakkına ilişkin Mahkeme kararları, ifade özgürlüğünü, şeffaf ve katılımcı bir demokrasinin hayata geçirilmesinde vazgeçilmez bir araç olarak ortaya koymuştur. Birçok açıdan Avrupa İnsan Hakları Mahkemesi içtihadına paralel kararlar üreten Amerikalılar-arası Mahkeme, Avrupa sisteminin sağladığı güvenceleri asgari bir standart olarak görmekte ve ifade özgürlüğünün korunmasında daha ileri bir noktaya ulaşmayı hedefl emektedir.

Abstract

Compared with other basic instruments relating to human rights, the American Convention on Human Rights treats the freedom of expression quite in detail. The Inter-American Court, body of judicial control provided by the Convention, has interpreted, through its judgments and advisory opinions, the scope of the freedom of expression broadly, the restrictions that can be applied to this freedom strictly. Forming a rich and consistent case-law in a short time, the Court has considered the freedom of expression not only as an individual right but also a social and cultural right assuming important missions. Especially, Court judgments regarding the right to access to information have recognized the freedom of expression as an indispensable instrument in the implementation of a transparent and participatory democracy. The Inter-American Court, which renders decisions in many respects parallel to the caselaw of the European Court of Human Rights, regardes the guarantees provided by the European system as a minimum standard and intends to achieve a further step in the protection of the freedom of expression.
