HISTORICAL DEVELOPMENT OF COMMUNITY SERVICE IN THE TURKISH CRIMINAL JUSTICE SYSTEM

Özet

Türk ceza adaleti sisteminde ceza politikaları, insan haklarına verilen kıymete göre yıllar içerisinde farklı aşamalardan geçmiştir. Özellikle toplum içerisinde infaz edilen ceza hukuku yaptırımları, çeşit ve içerik olarak bu gelişimden en çok etkilenmiş olan alandır. Bu çalışmada, 19. yüzyılda hürriyeti bağlayıcı cezaların olumsuz etkilerinin görülmesinin ardından gelişen; suçluların rehabilitasyonu, iyileştirilmesi ve topluma kazandırılması şeklindeki cezanın çağdaş amaçlarını gerçekleştirmenin bir aracı olarak ortaya çıkan kamuya yararlı bir işte çalıştırma kurumunun Türk ceza adalet sistemindeki tarihsel gelişim süreci ele alınmıştır. Bunun yanında çalışmamızda, toplum içerisinde infaz edilen ceza hukuku yaptırımlardan biri olan seçenek yaptırım olarak kamuya yararlı bir işte çalıştırmayı Türk Ceza Kanunu çerçevesinde incelemeye çalışacağız.

Abstract

In the Turkish Criminal Justice System, penal policies have gone through diff erent stages in proportion to the importance and value that is given to human rights in years. Especially, sanctions which are implemented in the community had been aff ected mostly from this development by variety and content. In this study, historical development in the Turkish Criminal Justice System of institution of community service which arised as a mean of carrying out the contemporary aims of the punishment such as rehabilitation, recovery and reintegration in to the society of the convicts and developed after the observation the negative eff ects of the punishments deprivating the liberty in the 19th century is discussed. In addition to this, in our study, we will try to examine community service as an alternative sanction which is one of the sanction implemented within the community in accordance with the Turkish Criminal Code.
