Özet
17. yüzyılın önemli teorisyenlerinden John Locke, siyasal iktidarın sınırlandırılması düşüncesini benimsemiştir. Bu düşüncesini kaleme aldığı "Yönetim Üzerine İkinci İnceleme" adlı eserinde, devletin kaynak ve kapsamını belirlemeye çalışmıştır. Locke, devletin sınırlandırılmasına ilişkin fikirlerini ortaya koyarken, sosyal sözleşme teorisini dayanak almıştır. Siyasal toplumla iktidar arasında yapılan bu sözleşme ile siyasal toplum bazı yetkilerini siyasal iktidara devretmiştir. Bunun karşılığında devlet, bireylerin tabiatından kaynaklanan "hayat, hürriyet, mülkiyet" haklarını koruma altına almakla yükümlü kılınmıştır. Siyasal iktidar sözleşmeden kaynaklanan bu yükümlülüğünü yerine getirmediğinde veya bir şekilde siyasal toplum gözündeki meşruiyetini kaybettiğinde siyasal toplum, sözleşmeyi feshederek yeni bir siyasal iktidar kurma hakkına haiz olacaktır. Siyasal topluma verilen bu hak, Antik çağdan beri tartışılan direnme hakkıdır. Bu hak, Locke tarafından sistematik bir zemine oturtmuştur.
Abstract
John Locke, one of the 17th century's most important theorists, has adopted the idea of limited political power. He tried to determine the source and extent of state in his book "Two Treatises of Government" in which he wrote up his idea of limited political power. Revealing this ideas for limited government has relied on the social contract theory. Political society transferred some powers to government by the agreement between each other. State, in return, was obliged to take under protection the rights of "life, liberty, power" which arises from the nature of individual. When political power defaults its obligation under this agreement at in any way loses its legimacy in the eyes of political society, political society will have the right to establish a new political power, by dissolving the contract. This right which is granted to the political society is right to resist which has been argued since ancient times. What Locke did was to put this right in a sistematic theoritical ground.
