Abstract

The c rculars that exam ned n th s study are nclud ng s gn f cant Powers g ven to the Pr me M n ster regard ng the c v l servants. By these C rculars, a number of ass gnments that are to be made by the adm n strat ons are ceased, and some of them are cond t oned on perm ss on from the Pr me M n ster. In order to be lawful, t s cruc al for these C rculars to be ssued n compl ance w th the law. However, these c rculars do not carry those requ rements. Bes de of th s, a vague language s used n these C rculars. Moreover, some const tut onal pr nc ples and rules such as nal enab l ty of leg slat ve power and the necess ty of the ex stence of a law n order to restr ct fundamental r ghts and freedoms and to regulate the publ c personnel reg me s v olated by these C rculars
